1. Acceptance of Terms
By accessing or using DominicanCitizenship.com (the "Platform"), operated by DominicanCitizenship.com ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. We reserve the right to update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
2. Description of Services
DominicanCitizenship.com is a legal technology platform that connects individuals seeking Dominican Republic citizenship by descent with independently licensed Dominican attorneys. The Platform provides:
- An eligibility assessment tool to help you determine whether you may qualify for Dominican citizenship by descent.
- A document management portal for organizing and submitting required application materials.
- Connection with licensed Dominican attorneys who specialize in citizenship-by-descent cases.
- Case management tools, including secure document upload, messaging, and status tracking.
- Payment processing through Stripe Connect.
Service offerings, pricing, and available features are described on the Platform and may change from time to time at our discretion. Current pricing is displayed at the time of purchase.
DominicanCitizenship.com is NOT a law firm.
We do not provide legal advice, represent clients in legal proceedings, or practice law. All legal services are provided directly by independently licensed attorneys who use our Platform. The Platform charges flat platform fees for technology and marketplace services and never takes a percentage of attorney legal fees, in compliance with ABA Model Rule 5.4.
3. Eligibility
You must be at least 18 years of age to create an account on the Platform. By using the Platform, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms. A parent or legal guardian may use the Platform on behalf of a minor to apply for citizenship by descent.
4. User Accounts and Responsibilities
When you create an account, you agree to:
- Provide accurate, current, and complete information during registration and throughout the application process.
- Maintain the security of your account credentials and not share your password with anyone.
- Notify us immediately of any unauthorized use of your account.
- Accept responsibility for all activity that occurs under your account.
- Upload only genuine, unaltered documents. Submitting fraudulent documents is grounds for immediate account termination and may be reported to the appropriate authorities.
5. Payment Terms
All payments are processed securely through Stripe. By making a payment, you agree to Stripe's Terms of Service.
Refund Policy:
All fees are generally non-refundable once payment is made. Partial refunds may be issued at our sole discretion on a case-by-case basis, typically only when services have not yet commenced. Attorney fees are paid directly to the attorney through Stripe Connect and are subject to the attorney's own policies.
By making a purchase, you acknowledge that refunds are not guaranteed and that you have reviewed the services selected prior to payment.
Prices are displayed in US Dollars (USD). You are responsible for any applicable taxes, bank fees, or currency conversion charges imposed by your financial institution.
6. Attorney-Client Relationship Disclaimer
Your use of the Platform does NOT create an attorney-client relationship between you and DominicanCitizenship.com. Any attorney-client relationship is formed solely between you and the independently licensed attorney you select through the Platform.
DominicanCitizenship.com does not supervise, direct, or control the legal work performed by attorneys on the Platform. Each attorney is independently responsible for the quality and outcome of their legal services. We do not guarantee any particular result or outcome for your citizenship application.
7. Intellectual Property
All content on the Platform, including but not limited to text, graphics, logos, icons, images, software, and the overall design and arrangement thereof, is the property of DominicanCitizenship.com or its licensors and is protected by copyright, trademark, and other intellectual property laws.
You retain ownership of all documents and personal information you upload to the Platform. By uploading content, you grant us a limited, non-exclusive license to store, process, and transmit your documents solely for the purpose of facilitating your citizenship application through your selected attorney.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DOMINICANCITIZENSHIP.COM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM.
Our total liability for any claim arising from or related to these Terms or the Platform shall not exceed the total amount you have paid to DominicanCitizenship.com (excluding attorney fees) in the twelve (12) months preceding the claim.
We do not guarantee the accuracy of the eligibility assessment tool, the approval of any citizenship application by the Dominican government, or the timeliness of any government processing.
9. Prohibited Conduct
You agree not to:
- Use the Platform for any unlawful purpose or in violation of these Terms.
- Submit fraudulent, falsified, or misleading documents or information.
- Interfere with or disrupt the Platform, servers, or networks.
- Attempt to gain unauthorized access to any part of the Platform or other users' accounts.
- Scrape, harvest, or collect data from the Platform without our prior written consent.
- Use the Platform to send unsolicited communications or spam.
10. Termination
We may suspend or terminate your account at our sole discretion, with or without notice, for any reason, including but not limited to a violation of these Terms. Upon termination, your right to use the Platform ceases immediately.
You may request account deletion at any time by contacting us at support@dominicancitizenship.com. Account deletion does not automatically entitle you to a refund of any fees already paid. Active cases will be handled according to the refund policy described in Section 5.
11. Dispute Resolution
Any disputes arising from or related to these Terms or your use of the Platform shall first be resolved through good-faith negotiation. If a resolution cannot be reached within thirty (30) days, either party may pursue binding arbitration in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall take place in San Juan, Puerto Rico, United States, and the language of the proceedings shall be English.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Puerto Rico and applicable federal law of the United States, without regard to conflict-of-law provisions. Where applicable, the laws of the Dominican Republic may apply to matters related to the citizenship application process itself.
13. Indemnification
You agree to indemnify, defend, and hold harmless DominicanCitizenship.com and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
